Trump’s Sentencing Delayed Until September

(DailyDig.com) – On July 2, the Supreme Court judge of New York, Juan Merchan, delayed the sentencing of former President Trump from July 11 to September 18. On July 1, the US Supreme Court ruled that US presidents have prosecutorial immunity for any actions taken in the official capacity of the office of president but no immunity for actions taken in an unofficial capacity.

Alvin Bragg, the District Attorney for Manhattan, stated that he had no objections to Trump’s request to delay his sentencing due to the ruling. Before imposing any sentence based on Trump’s conviction, the New York court will have to consider the ruling.

Even though they believe Trump’s arguments for dismissal are invalid, the DA’s office assistant wrote to Judge Merchan that they don’t oppose his filing of a motion to presume a dismissal of the conviction after the motion’s determination. The judge then rescheduled the sentencing, if necessary, after the courts determined the validity of the US Supreme Court’s ruling, from July 11 to September 18 at 10 a.m.

In their motion for the conviction’s dismissal, the attorneys for Trump will argue that some of the trial’s evidence, including posts made on social media, should have fallen under the July 1 ruling on presidential immunity. They seek the reversal of Trump’s conviction on 34 felony counts related to allegedly fabricated business records.

Trump’s attorneys have requested that they file the documentation on July 10 to support the motion to vacate the conviction. The Manhattan DA’s office team requested their response to the motion for July 24. Judge Merchan set the date for his ruling on Trump’s motion to vacate his conviction for September 6.

The federal court denied Trump’s attorneys’ request to shift the trial from New York to a federal court before the trial began. The federal judge declared that the case pertained to Trump’s business records, as per the accusations, and had nothing to do with his official position or responsibilities as the US President.
